En este trabajo se examinan algunas cuestiones clave para la mejora de las pruebas periciales en el sistema penal mexicano a partir de las reformas que supone el Código Nacional de Procedimientos Penales, materia en la que éste es especialmente oscuro. La selección de los temas y, sobre todo, su abordaje, parte de la epistemología jurídica, asumiendo como objetivo de la institución probatoria la averiguación de la verdad y atendiendo a los diferentes sujetos en juego.

Background: The prevalence of anxiety and depression in young students is associated with biosocial factors and scholastic stress. However, few studies have evaluated emotional-affective symptoms that are related to the immune system and antioxidant parameters in young individuals without diagnoses of affective disorders.Aim: This study aims to assess the relationship between emotional-affective symptoms and glutathione concentrations and CD4 and CD8 lymphocyte counts in college students.Methods: College students completed standardized psychometric instruments, including the Perceived Stress Scale, Hamilton Anxiety Scale, Beck Depression (...) Inventory, Familiar Social and Friends Support Scale, and Rosenberg Scale. Blood samples were biochemically analyzed. Analyses of variance were conducted between four groups according to symptom severity.Results: A considerable prevalence of stress, anxiety, and depression symptoms was observed and negatively correlated with self-esteem and socio-familiar support. Perceived stress was sexually dimorphic. Although biochemical parameters were within reference ranges, glutathione, CD4, and CD8 tended to be lower in participants with anxiety and depression symptoms, which may be of predictive value.Conclusion: The relationship between antioxidant/immune parameters and socio-affective scores is latent in undiagnosed college students who might develop affective disorders. The findings suggest that during the initial development of affective disorders, stress management strategies should be implemented to help college students cope with the academic load and monitor negative changes in their physiological state. Uno de los temas recurrentes en el análisis de la prueba pericial, al menos en los sistemas de tradición romano-germánica, es la parcialidad o imparcialidad de los expertos, fundamentalmente considerada como un criterio para la atribución de valor probatorio. Por ello, vale la pena profundizar en este tema, distinguiendo en primer lugar diversos sentidos de “im/parcialidad”, para luego concretar mecanismos jurídico-procesales que ayuden a identificar cuándo un perito está siendo parcial a lo largo de las diferentes etapas probatorias.

This book offers a transnational perspective of evidentiary problems, drawing on insights from different systems and legal traditions. It avoids the isolated manner of analyzing evidence and proof within each Common Law and Civil Law tradition. The company at the service of today's society is reinventing itself to satisfy people's needs in a more efficient and adapted way. Globalization and digitization promote increasing interaction and new forms of economic organization such as collaborative economy. However, can it be understood that this new business model, more than others, has as its raison d'être in the search for the “common good”? A first approach suggests the presence of values related to collaboration between equals aiming at a common good. (...) However, the possible existence of a profit motive and the labor relations framework in which certain activities are carried out have created a debate on their ethical qualification. In this context, considering 278 companies in the collaborative economy sector, the relationship between the concept of “common good” and the collaborative economy is analyzed, while examining whether these new realities have an explicit ethical intention (of search for goods for people). According to the results, it is not possible to assert that these platforms have an ethical concern, but it is observed that they are in line with the common good and implicitly contribute to the service of society. Nowadays, the quality standards of higher education institutions pay special attention to the performance and evaluation of the students. Then, having a complete academic record of each student, such as number of attempts, average grade and so on, plays a key role. In this context, the existence of missing data, which can happen for different reasons, leads to affect adversely interesting future analysis. Therefore, the use of imputation techniques is presented as a helpful tool to estimate the value of missing (...) data. This work deals with the academic records of engineering students, in which imputation techniques are applied. More specifically, it is assessed and compared to the performance of the multivariate imputation by chained equations methodology, the adaptive assignation algorithm based on multivariate adaptive regression splines and a hybridization based on self-organisation maps with Mahalanobis distances and AAA algorithm. The results show that proposed methods obtain successfully results regardless the number of missing values, in general terms. (shrink)

The First World Congress on Evidential Legal Reasoning, organised by the Legal Culture Chair of the University of Girona, was held between June 6 and 8, 2018. The Congress was attended by 350 participants and featured 18 speakers from four continents. The three days of formal and informal presentations and discussions yielded excellent results, strengthening the interrelation between the legal communities and specialists of different traditions. The 18 papers from the Congress, reviewed by their authors based on the discussions and (...) the suggestions made at the Congress, have been compiled in this book. (shrink)

The ‘black box’ in Stoic axiology refers to the mysterious connection between the input of Stoic deliberation (reasons generated by the value of indifferents) and the output (appropriate actions). In this paper, I peer into the black box by drawing an analogy between Stoic and Kantian axiology. The value and disvalue of indifferents is intrinsic, but conditional. An extrinsic condition on the value of a token indifferent is that one's selection of that indifferent is sanctioned by context-relative ethical principles. The (...) value of an indifferent that does not meet this condition is normatively silenced, such that it fails to constitute a reason for action. (shrink)

It has been pointed out that Sensorimotor Enactivism, a theory that claims that perception is enacted and brought about by movement, says very little about the neural mechanisms that enable perception. For the proponents of the predictive approach to Sensorimotor Enactivism, this is a challenge that can be met by introducing predictive processing into the picture. However, the compatibility between these theories is not straightforward. Firstly, because they seem to differ in their stand towards representations: while Sensorimotor Enactivism is said (...) to belong to the non-representational wing of cognitive science, predictive processing has a representational profile. And secondly, because they exhibit different explanatory strategies: while Sensorimotor Enactivism prioritizes the interactions of the embodied agent, predictive processing has internalist commitments. The aim of this paper is to address these concerns and show that a predictive approach to Sensorimotor Enactivism is viable. More specifically, I focus on the Free-Energy approach, a theory that falls within the ballpark of predictive processing. In this paper I argue for the following claims. I argue that both Sensorimotor Enactivism and the Free-Energy approach may be understood for some systems in representational terms. The non-representational reading of Sensorimotor Enactivism is not mandatory and neither is the representational reading of the Free-Energy approach. Sensorimotor Enactivism is, in this respect, compatible with both representational and non-representational interpretations of the FEA. So, the position towards representations of these frameworks should not stand in the way of a predictive approach to Sensorimotor Enactivism. I also show that the Free-Energy approach allows for an account that prioritizes the interaction of the embodied agent with the environment. This is the explanatory strategy followed by Sensorimotor Enactivism. To justify this strategy and following other proponents of Sensorimotor Enactivism, I argue that by referring to the interactions of the embodied agent a better account of the phenomena in question is provided. On this basis, I claim that Sensorimotor Enactivism and the Free-Energy approach are compatible in what concerns their explanatory strategy as well. Thus, making the case for the viability of the predictive approach to Sensorimotor Enactivism. (shrink)

Advocates of the ethical criticism of art claim that works' ethical defects or merits have an impact on their aesthetic value. Against ethical critics, autonomists claim that moral criteria should not be part of the considerations when evaluating works of art as art. Autonomism refers to the view that an artwork's aesthetic value is independent from its ethical value. The purpose of this paper is to examine how autonomism has been defended in the contemporary discussion in analytic aesthetics. I present (...) three versions of autonomism: Richard Posner's radical autonomism, James C. Anderson and Jeffrey T. Dean, and James Harold's moderate autonomism, and Francisca Pérez Carreño's robust autonomism. I argue that robust autonomism offers a stronger argument against the ethical critic. However, I point to some difficulties for Pérez Carreño's account and conclude by suggesting how further work in autonomism might go around them. (shrink)

Resumen: Chile, a pesar de su historia migratoria, no ha generado programas educativos sustentados por políticas gubernamentales que propicien la adquisición de la variedad lingüística de la comunidad de acogida, por parte de la inmigración no hispanoparlante, integrando los referentes culturales de ambos colectivos. Se propone una alternativa a este olvido histórico y nos planteamos lo siguiente: ¿Qué elementos debiesen integrar un programa de adquisición de la variedad lingüística de la comunidad de acogida dirigido a inmigrantes haitianos propiciando el conocimiento (...) cultural? Se presenta el diseño e implementación de un programa que adopta la Hipótesis de Interdependencia Lingüística, en un aula dinámica donde se trabaja de forma colaborativa y situada. Se concluye que es posible educar en una segunda lengua a partir de la incorporación de elementos que propicien la interrelación de los aprendices en igualdad de conocimientos, y el uso de los códigos lingüísticos de los participantes como manifestación de respeto e interés por lo que cada uno pueda aportar a partir de su L1, develando su cultura de origen.: Chile, despite having a migration history, has not generated educational programs supported by government policies that encourage the acquisition of the linguistic variety of the host society, by non-Spanish-speaking immigration community, integrating the cultural referents of both collectives. It is suggested an option to this historical oblivion and we consider the following: What elements should be integrated into a program for acquiring the linguistic variety of the host society focused to Haitian immigrants fostering the cultural recognition? It is presented the design and implementation of a program that adopts the Linguistic Interdependence Hypothesis in a dynamic classroom working in a collaborative and situated way. As a conclusion, it is possible to educate in a second language from a program that incorporates elements that promote the interrelation of all participants in equality of knowledge, as well as the use of participants’ linguistic codes as a manifestation of respect and interest for what each participant can contribute from his/her L1, revealing their culture of origin. The debate is concerned with “the intrinsic question”: the question of whether ethical flaws/merits in artworks’ manifested attitudes affect their aesthetic value (Gaut 2007: 9). This paper argues that the assumption that artworks have intrinsic ethical value is problematic at least in regards to a significant subset of works: fictional artworks. I argue that, insofar as their ethical value emerges only from attitudes attributable to (...) actual agents, fictional artworks only have extrinsic ethical value. I show that what is at stake for interactionism is whether ethical judgements concerning artists’ attitudes in a context, rather than manifested attitudes, are ever aesthetically relevant. I conclude that, without buying into extreme actual intentionalism, a still controversial theory of interpretation that ties artworks’ meaning to actual artists, interactionism fails to show that ethical flaws/merits are aesthetic flaws/merits. Tanto es así que Rawls en la Teoría de la Justicia lo eleva a la categoría de bien primario más importante. El ser humano que se estima y respeta a sí mismo está dotando a su vida de un incalculable sentido moral y convierte su existencia en un proyecto pleno y meritorio. La autoestima proporciona al individuo un sentido de su propia valía (...) y le asegura la confianza necesaria para emprender y desarrollar un proyecto de vida significativo. La humillación y la vergüenza menoscaban las bases del autorrespeto y suponen un daño a la dignidad humana. (shrink)

El presente trabajo se enmarca en la propuesta fenomenológica de Jean Luc Marion, comenzando por la crítica que él realiza a Husserl y Heidegger. Luego de adentrarnos en lo fundamental de su propuesta fenomenológica, ‘cuanto de reducción, tanto de donación’, podremos acercarnos a comprender la llamada que genera y su fenomenalización por medio de la respuesta que se apila en nuestra carne. Frente a lo propuesto por Marion, esperamos encontrar una posibilidad de acercarnos a indicios del pensamiento filosófico de Cristo (...) sobre el rol del tercero y su testimonio. El trabajo se centra, por lo tanto, en los rastros que nos deja el pensamiento de Cristo, que puede ser esbozado a partir de una escapatoria al pensamiento griego. (shrink)

Data are lacking with regard to participants' perspectives on return of genetic research results to relatives, including after the participant's death. This paper reports descriptive results from 3,630 survey respondents: 464 participants in a pancreatic cancer biobank, 1,439 family registry participants, and 1,727 healthy individuals. Our findings indicate that most participants would feel obligated to share their results with blood relatives while alive and would want results to be shared with relatives after their death.

En este artículo se quiere ahondar en la propuesta que Jean Luc Marion ofrece sobre el ídolo en relación con el icono y cómo esta puede aportar al pensamiento artístico. Para esto, abordaremos la relación del ídolo con los distintos rostros que pretenden mostrarse como tal y luego el pensamiento sobre el icono cristiano. En este sentido, nos adentraremos en la propuesta estética cristiana y la posibilidad de pensar un arte a posteriori, es decir, que surge desde un acontecimiento, extendiéndolo (...) y haciéndolo más visible. Latin America is one of the most unequal continents in the world. This inequality translates into marked limitations in the possibilities of having a decent life for a high percentage of the population. Within the groups that are affected, women are undoubtedly even more so, because, in addition to shared economic and social inequalities with other vulnerable groups, they face discrimination based on gender. In Latin America, political protest has been undertaken by women who wish to denounce and abate the (...) injustices of which they are victims. These struggles have been analyzed by different thinkers. For the most part, feminist theories deal with the struggle of women against the oppressive behavior of patriarchy from the State or society. Others highlight the ability of women to contribute to social changes from socially accepted roles such as mothers, daughters, wives. These approaches ignore the difficulties experienced by female activists within the political mobilization. In this essay then we seek to document, analyze, and theorize about the patriarchal practices suffered by women activists - qua women- within the social organizations in Ciudad Juárez, as well as the forms of resistance they have opposed. Work in feminist and critical race aesthetics brings out a complex interaction between aesthetic, ethical, and political value. The interest in ethico-political considerations is also found in recent literature around art and ethics, such as debates about the work of immoral artists, cultural appropriation and heritage, and art in public spaces. These discussions are characterized by a social structural approach to the ethico-political value of art that focuses on relations between artworks, other artefacts, and individuals in specific sociohistorical contexts and (...) as they emerge from specific social organizations. In this paper I present the main features and assumptions behind these social structural approaches to the values of art. I examine accounts that take ethico-political value to depend on artworks’ contributions to public discourse and on their role in constituting social structures. (shrink)

Gene editing techniques, such as CRISPR, are being heralded as powerful new tools for delivering agricultural products and foods with a variety of beneficial traits quickly, easily, and cheaply. Proponents are concerned, however, about whether the public will accept the new technology and that excessive regulatory oversight could limit the technology’s potential. In this paper, we draw on the sociotechnical imaginaries literature to examine how proponents are imagining the potential benefits and risks of gene editing technologies within agriculture. We derive (...) our data from a content analysis of public comments submitted to the Food and Drug Administration’s 2017 docket titled “Genome Editing in New Plant Varieties Used for Food.” Our sample frame consists of 26 comments representing 30 agriculture and biotech companies, organizations, and trade associations. Our findings reveal three key sociotechnical imaginaries, including that gene editing technologies in agriculture: are not GMO but instead equivalent to traditional plant breeding; have the potential to usher in a new Green Revolution; and could facilitate the democratization of agricultural biotechnologies. We argue that forming and projecting these collective interpretations of the potential of gene editing technologies for crops and foods plays an important role in efforts by proponents to influence regulatory oversight, modes of governance, and build public acceptance. This research contributes to calls by science and technology studies scholars to investigate emergent concerns and imaginaries for novel technoscientific advances to help inform upstream models of public engagement and governance decisions. El presente artículo intenta ofrecer un marco documental para la discusión sobre la estructura cosmológica de Ferecides de Siros. Partiendo de la polémica entre quienes le adjudican un cosmograma quinario y aquellos que lo interpretan septenario, proponemos un recorrido por las antiguas doctrinas cosmológicas quinarias, tanto griegas como orientales, a fin de explorar su recurrencia y variedad. Se constata que la disputa religiosa entre los apologetas del cinco y los del siete existía ya en la antigüedad, pudiendo haber afectado a (...) la lectura que los doxógrafos hicieron entonces de la obra de Ferecides. Se expone la teoría de Nick Allen sobre la existencia de una «ideología pentádica» indoeuropea y se critica su sesgo idealista (pitagórico en la línea de Dumézil). Finalmente, se suscribe la hipótesis del origen «protogeométrico» de muchos de estos mapas ontológicos quinarios y se recapitulan las posibles referencias que manejaba el maestro de Pitágoras cuando ideó su teogonía. The perception of sensory effects generated by one’s own actions is typically attenuated compared to the same effects generated externally. However, it is unclear whether this specifically relates to self-generation. Recent studies showed that sensory attenuation mainly relies on action preparation, not actual action execution. Hence, an attenuation of sensory effects generated by another person might occur if these actions can be anticipated and thus be prepared for.Here, we compared the perceived loudness of sounds generated by one’s own actions and (...) actions of another person that either could or could not be anticipated. We found an attenuation of the perceived loudness for self- as compared to other-generated sounds. This difference was independent of whether the sound-eliciting actions of the other person could be anticipated or not. Thus, sensory attenuation seems to be specifically tied to self-generation instead of being a secondary effect of agent-independent preparation for an upcoming action. (shrink)
